The Halachic Prenuptial Agreement Prevents Get Abuse

July 23, 2021 – As we observe Tu b’Av on the Jewish calendar and as weddings resume following Tisha b’Av, the Rabbinical Council of America, the leading membership organization of orthodox rabbi to North America, reminds the community of the importance of brides and grooms signing a halachic prenuptial agreement before they are married. This document, developed by Rabbi Mordechai Willig has been endorsed by some of the leading and most respected halachic authorities of our generation including R. Ovadia Yosef, zt”l; R. Zalman Nechemia Goldberg, zt”l, R. Gedalia Dov Schwartz, zt”l; and, ybl”t, R. Asher Weiss, and which is promulgated by the RCA and the Beth Din Of America, has proven to be the most effective tool in preventing the withholding of a get, a Jewish divorce, by a recalcitrant spouse.

Rabbi Binyamin Blau, president of the RCA, said, “Contrary to the opinion of some of its detractors, the halachic prenuptial agreement does not encourage divorce. It does, however, most importantly, prevent the abuse of the parties involved and the manipulation of Halacha when a marriage has failed.”
